PATTAYA COURT RULES IN FAVOUR OF SCOTS FRAUDSTER (UPDATED)

A WARNING TO EXPATS!

A Briton who ‘intruded’ into the bar of a convicted Scottish fraudster in Pattaya after finding out the man was not the officer and gentleman he claimed to be, has been found guilty of defamation and trespass by a Pattaya Court.

Estate agent Andy Mathews ,49, from Wolverhampton, had lent Brian Goudie almost  £10,000, and had just been told that Goudie was NOT formerly a Captain in the Royal Marines and a barrister. Mathews had even employed him as his own legal counsel in a previous case.

When he found out, he reacted by going round to Goudie’s bar during opening time and causing a storm.

Goudie had stopped repaying the interest free loan and Mathews was broke.

When it came to court Mathews employed a recommended lawyer whom he said could not speak English, and whom he was to discover ignored his requests, and never answered his calls. Having paid,he had no cash to find another one.

This story serves as a warning. Be careful if you are cheated in Thailand. You can easily end up as the defendant.

Convicted Scottish fraudster Brian Goudie has claimed victory over a man, who claimed he owed the equivalent of £10,000, by pursuing him in the Pattaya Court and bringing charges of defamation and trespass against him.


The case was taken by Goudie and, according to Goudie, the parent company Jimmi International, which owns the ‘Jaggy Thistle’ pub in Pattaya where the fracas occurred.

Jimmi International was formerly the property of Jimmy ‘Doc’ Halliday a notorious Ulster drugs dealer, who apparently signed over his power of attorney to Goudie on his death bed in the Bangkok-Pattaya Hospital last year.  
Halliday died of necrotising fasciitis, a flesh eating disease, acquired in Nong Plalai Prison, Banglamuang.
Andy Mathews was a previous client of Goudie’s company Alba Laws.
Mathews was sentenced to a total of 16 months in prison on two defamation and two trespass charges, Goudie proudly reports on his pseudo Legal Website Asia-Case-watchers. The sentences were however suspended. 
Mathews, from Wolverhampton, was further fined 6000 baht and ordered to do community service.
Andy Mathews said had gone to remonstrate at the Jaggy Thistle pub in Pattaya with Goudie and John Macdonald, a former Glasgow taxi driver, and Pattaya Police Volunteer, after discovering that Goudie was not a Royal Marine Commando Captain as he claimed, nor was he a barrister. He was concerned about his cash.
It is not clear from Goudie’s court report whether Mathews also knew Goudie, a former bank clerk and club bouncer had been jailed for three terms of 2 years imprisonment in Australia for fraud (under the name he was born with, Brian Gerald Goldie), and that an arrest warrant had issued by the Lothian and Borders Police in 1994, for fraud which he had avoided facing.

Quoting himself after the case Goudie said:

 “Unfortunately for Mathews the whole incident was caught on a mobile telephone camera, and CCTV, as Mathews moves in and out of the premises screaming at John McDonald and Brian Goudie.

 “The Court rejected Mathews defence that he had come to ‘talk’, and had made no threats, the gentleman in the red and black shirt is an off duty police officer, and the shorter person to the rear is clearly wearing a ‘man bag’ with a Royal Thai Police logo.

“Mathews was asked to leave the premises many times, but refused to do so, and after first leaving the premises came back twenty minutes later with his ‘heavy team’ of three off duty police officers – a police report was taken at Dong Tan police station the same day, prior to the case being filed with the Court.

 “Myself and my colleagues and friends have been subjected to months of on-going abuse from this man, who seems to think that he can solve any problem with threats of violence and bullying tactics, and I am glad that the Court saw through his defence – it is very hard to deny this type of thing when you are caught on CCTV cameras shouting and screaming and threatening other people – in the end I believe the Court has come to a very balanced and reasoned decision.

“We offered to settle the dispute many times, but Mathews thought he could bully us with his violent behaviour, and threatening us with his ‘police friends’ and now the Court has shown that we were right not to bend to the threats and abuse.  (US? ed)

“Many foreigners when faced with police in Thailand are just too scared and end up giving in but we knew this was just an empty threat as the police were not in uniform and had no documentation – and left very quickly when local police became involved.

“Even on the day he was sentenced Mathews has kept on sending SMS messages threatening us with what he is going to do, and we are now looking at the possibility of further charges in the very near future if it doesn’t stop.

“Even with all the adverse publicity and comments that we have been subjected to in the media, we were advised by our lawyers not to make any comment prior to the verdict of the court, and we are relieved that this has been decided in our favour’.  (we?)

“Lawyers acting for the Plaintiffs are now reviewing the sentence and considering whether or not to lodge an appeal to Rayong Provincial Appeals Court on the basis that the sentence was ‘manifestly inadequate’ in light of Mathews multiple convictions.

“Mathews had previously involved a Bangkok based UK journalist in the case, Andrew Drummond, who is now also being prosecuted for defamation in connection with his reporting of this case. It was noted that Drummond – who has reported this case at every opportunity allegedly saying Mathews was wrongfully accused – had not as at today reported Mathews conviction on all charges this week”

Contacted last night Andy Mathews, according to Goudie also a former nightclub bouncer said:

 “My lawyer does not speak English and never answers my calls. Having paid him I could not afford to pay another lawyer.  

“Goudie was trying to get me into jail, because I had been convicted before, while he was supposedly representing me for punching a German developer who had swindled me. He hoped the court would impose a previous suspended sentence.  

“I never even saw Goudie in court. My lawyer was telling me to come one day, not to come another day. On  the day Goudie was there I was not. When I went he was never there. It was a farce. 

” I am on holiday at the moment. The pressure is off me and I can now relax. I am very interested in Goudie’s offer to pay me back. The matter is not closed.”



Footnote: Brian Goudie has been contributing to andrew-drummond-watch.blogspot site with Drew Noyes, but asia-case-watchers appears to be his own brainchild. Last week he sent ‘ news copy’ to newspapers in the UK using his ramidin@gmail account and linking to the case-watch site. The copy was spiked by all recipients.


Andrew Drummond is not being sued in connection with Andy Mathews. Libel and computer crime complaints have been made about the story below which was printed in Scotland. Goudie is not suing in Scotland. The cases have yet to be accepted in Thailand.  

In all reports on Goudie and Mathews nowhere has it been stated by the author that Mathew  was ‘wrongly accused’ as Goudie writes. 

Even if the author thought that were true (which he does) journalistically he would not be able to say it without providing evidence and witnesses and taking on the case himself. 

But he does say say that Mathews was understandably furious and went to Goudie’s bar during opening hours to give him a piece of his mind and demand his cash back.

Mind you if anyone received an sms like this (right) froma former friend and former lawyer -he would be encouraged to think he was certainly not getting his money back.

Mathews has however stated himself that he was wrongly accused.

It has been  pointed out that foreigners who believe they have been cheated in Thailand can and will be taken to court for defamation if they try and act without proper legal advice. A lot of criminals have cottoned on to these laws.  The criminal libel laws have been used to send many a victim scurrying home. Its not just used against journalists. You may think its unfair but convicted criminals may know a lot more about the local legal system and how to deal with it than you. They can be evil, sneaky, ruthless, vile and thorough.

Finally Goudie has not clarified who are the ‘we’ he is talking about. The only other plaintiff appears to be an inanimate object. For ‘we’ read “The Jaggie and I” or perhaps ‘Harvey and I’.

176. Looking then at all these matters, I have concluded that Mr Goldie is not of good character. The lack of honesty and integrity which he has displayed in his dealings with the Department and his lack of integrity (in the sense of wholeness, soundness and uprightness) in not confronting the allegations of fraud in Scotland are not outweighed by the good reports he has received from some of his past employers 

177.Having found that Mr Goldie is not of good character, I must consider whether the discretion should be exercised in his favour provided he met all other criteria. I have decided that the discretion should not be exercised. Mr Goldie has formed ties with an Australian citizen, Ms Finnis, but has no other particular personal ties with Australia…..If he returns to Scotland he will presumably have to face the outstanding charges but that is a matter which will have to run its course under Scottish law and is not a matter which should sway the exercise of the discretion in this case. Taking all these matters into account together with the findings I have already made, I have concluded that the discretion should not be exercised in his favour.

Above – Why an Australian Appeals Tribunal Deputy Judge did not want Gaudie/Goldie in Australia – and this was BEFORE he was convicted of fraud there. Despite the ATT’s decision he managed to hang on long enough in Australia to avoid the Scottish charges. He did it  by making a claim his wife assaulted him – and thus drew out a long court process. In short he knows how to play the courts. Then of course he was arrested and jailed for defrauding the mining company he worked for.


COMMENT:

A 16 month suspended sentence for being angry for learning the man you trusted with 420,000 baht is a convicted cheat seems a little high. Mathews must have had the proverbial Thai lawyer from hell to deal with what the Sunday Mail described as the ‘Devil’s Advocate’

  2. Hell, I have had worse altercations with employees demanding money I didn't owe them. Needless to say, I didn't phone the police.

    1. My burning question is…

      Did Brian represent himself as a member of the bar in the court? Apparently Pattaya has banned him from representing others in court, did Brian have the balls to represent himself in Samui, or did he use the money he allegedly defrauded that poor 74 year old lady to buy himself a lawyer?

  3. This just goes to demonstrate how parasites such as Goldie/Goudie play the justice system. Its unfortunate that Mr Mathews fell into his trap, and that is a shame. To go to this immoral, unethical inadequate hang out and to confront him, man to wretched dog, for me takes courage.

    Also….I didn't realize that Wee Burney was so fat…wow. you've lets you self go, Did I read right….he was a bank clerk and doorman? Not a war hero? That's a contradiction….a door man of what….a youth club? Its like having a gerbil as an attack dog or Noyes and MENSA……

    The only consolation…again if this was an accurately reported decision, is that nobody in their right mind will ever engage in any sort of business with this verminous man again…although I expect him to be banding and spinning about more libellous allegations, as he has done with me. He's a spent force. Where next…..lets be honest….Australia wont have you…you're BANNED due to being a convicted fraudster…….how many years was it at Her Majesty's pleasure????

  4. Section 12 of the Thai Immigration Act lists the grounds under which any alien is prohibited from entering the Kingdom;

    Paragraph 6 says: Having been imprisoned by the judgement of the Thai Court; or by a lawful injunction; or by the judgement of the Court of foreign country, except when the penalty is for petty offense or negligence or is provided for as an exception in the Ministerial Regulations.

    Paragraph 11 says: Having been deported by either the Government of Thailand or any other foreign countries; or the right of stay in the Kingdom or in foreign countries having been revoked; or having been sent out of the Kingdom by competent officials at the expense of the Government of Thailand unless the Minister shall consider exemption on an individual special case basis.

    At the very least this guy has been convicted & imprisoned in Australia for serious crimes and, I would presume, deported from Australia afterwards. Why is he still here in Thailand? Can't this be brought to the attention of the Immigration Department – at a high enough level that he can't easily buy his way out of it?

    What a topic…although I feel no sadness, sympathy or understanding for him or even his self imposed situation, he dug himself into this, no body else is/was responsible, he's just a thoroughly BAD apple, I only feel for his many, many victims….

But I would remind posters that in the last case being brought by Drew Noyes – all others have failed – I am being sued over readers comments. This is a little bit silly because I have said much stronger things about him which he is not suing over. Thanks

    1. I'm not sure Ally. I think he wants his day in court. No, actually he is suing me over the Sunday Mail story, which was not published here. Well actually I published what the story looked like but you cannot read the text only the headlines. He's also claiming he was never on the run – which flies in the face of the ATT judgment. I do not believe he will hang around too long, more's the pity.

    Brian Goudie / Brian Goldie is coming to the very same Pattaya Court claiming someone has defamed him AFTER testimony has shown that he's faked his status as a barrister and a former Marine in the same courts.

    The guy has balls of steel, I'll give him that.

    What baffles me is that when something like this comes to light is why the Thai police haven't arrested him for false representation with the intent to defraud? It's an open and shut case.

    I thought the one thing lawyers and judges hated more than criminals was fake lawyers.

  12. This just in and submitted on the old thread 'Scots fraudster Goudie insists 'I'm a member of the Bar'

    I lived in Thailand for about 4 years and spent time with Andy Mathews who you have mentioned in your writings. I came to Thailand, as most, for a two week holiday but stayed much longer and should have probably gone home much sooner. I actually knew Andy as "Andy from Wolverhampton" and found this story while I was trying to contact him to thank him for the help and kindness that he showed me while I was living in Jomtien.
    I remember being at the "Jaggy Thistle", although I don’t remember it being called that, attending the birthday bash of the Son of John McDonald with Andy Mathews and a couple of other friends of ours. I don’t remember meeting Goldie or the other trash that you write about but I will tell you this. Andy Mathews was one of the nicest people that I met while I was living in Thailand and he never had a bad word against anybody. I wouldn’t say that he was an easy target but I can see how somebody could take advantage of his kind nature.
    I can also state that he had no involvement in any kind of illegal business or any kind of "rackets" or "associated with knuckle dusters, knives, drugs, and violence" to any degree. What I would say is that he reminds me of my Father who wouldn’t bow down to any form of bullying especially, as you have stated, from somebody who could threaten to have you removed from the Kingdom of Thailand.
    Andy helped me while I was in need but I wasn’t in need of financial help, even though I’m sure he would have helped me in that situation. Andy managed to get an ambulance for my girlfriend, who would certainly have died without it, on a day that all ambulance were not available, Thai Holiday or something like that, a true gentleman!
    I can only hope that this Goldie guy is thrown out of Thailand after he has returned the money owed to Andy Mathews and probably others.
    I have found your writing very interesting Andrew, what is the latest on this Goldie character?

  13. You need to look up an old friend of mine called Sue. She is a Thai Solicitor on Soi L.K.
    She loves cases like this and speaks excellent English also. She would deal with this parrasite Goldie Balls and eat him for breakfast!
